These Terms of Use (“Terms”) govern your access to and use of the Waveny LifeCare Network website located at www.waveny.org (the “Site”), operated by Waveny LifeCare Network (“Waveny,” “we,” “us,” or “our”), a nonprofit corporation located at 3 Farm Road, New Canaan, Connecticut 06840.
By accessing or using the Site, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, please do not use the Site.
We reserve the right to update these Terms at any time. Revisions will be posted with an updated effective date. Your continued use of the Site following any changes constitutes your acceptance of the revised Terms.
2. Permitted and Prohibited Use
2a. Permitted Use
You may use the Site for lawful, personal, non-commercial purposes consistent with these Terms, including learning about Waveny’s services, submitting inquiries, scheduling tours, making donations, and accessing publicly available content.
2b. Prohibited Conduct
You agree not to:
- Use the Site for any unlawful purpose or in violation of any applicable law or regulation
- Transmit content that is harmful, defamatory, fraudulent, harassing, or otherwise objectionable

3. Healthcare and Medical Disclaimer
All content on this Site relating to healthcare, medical conditions, treatments, services, and care options is provided for general informational purposes only. It is not intended to be, and should not be construed as, medical advice, diagnosis, or treatment.
Nothing on this Site creates a physician-patient relationship or a care agreement. Always consult a qualified healthcare professional regarding any medical condition or care decision. Never disregard professional medical advice or delay seeking it based on information you read on this Site.

You represent and warrant that you own or have sufficient rights to the content you submit, and that it does not violate any third-party rights or applicable law. Waveny reserves the right to remove any submitted content at its discretion.
6. Online Donations
Waveny LifeCare Network is a 501(c)(3) tax-exempt nonprofit organization. Donations made through the Site may be tax-deductible to the extent permitted by law; please consult your tax advisor.
Donation transactions are processed through a secure, encrypted third-party payment processor. Waveny does not store full payment card numbers on our systems. All donation transactions are considered final. If you believe a donation was processed in error, please contact us within 30 days at (203) 594-5200 or info@waveny.org.
7. Volunteering and Employment
Information submitted through volunteer interest forms or career applications is used solely to evaluate your suitability for volunteer roles or employment with Waveny. Submission of an application does not constitute an offer of employment or a volunteer placement.

The Site may contain links to third-party websites for informational purposes. These links do not constitute an endorsement of those sites or their content, products, or services. Waveny has no control over and assumes no responsibility for the accuracy, content, privacy practices, or availability of any linked third-party website.

11. Limitation of Liability

13. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the State of Connecticut, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the state or federal courts located in Fairfield County, Connecticut, and you consent to personal jurisdiction in those courts.
14. Severability and Entire Agreement
If any provision of these Terms is found to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Waveny regarding your use of the Site.
